Comprehensive Stormwater Ordinance

The City of Wilmington is a National Pollution Discharge Elimination System (NPDES) Phase II community. Federal Law requires that the City of Wilmington implement a Stormwater Ordinance that includes Post Construction Controls. This permitting process is required by the Clean Water Act and applies to urbanizing areas.

The City of Wilmington’s Stormwater Ordinance that includes the NPDES Phase II Post Construction Controls was adopted by the Wilmington City Council effective on November 1, 2009. The City’s Comprehensive Stormwater Ordinance applies to all new development, redevelopment and expansion or modification of existing development. It regulates both water quality (pollution) and water quantity (volume) with regards to run-off generated by development activities. For many projects, it will replace the State Stormwater Permit process currently administered by the NCDENR – Division of Water Quality.

NC Session Law 2018-145 was passed by the legislature in December, 2018.  The memo below outlines the impacts to the redevelopment and vegetated buffer portions of the City Stormwater Ordinance.


A project will either be required to obtain a Stormwater Permit or Drainage Plan approval as described in the flowchart above. The forms required for each type of review are listed below.

All forms must be submitted along with the appropriate plan review fee in order for a project to be considered for review. The project will be reviewed for completeness based upon the applicable checklist, required forms, operation & maintenance agreements and supplements. If any components of the submittal are missing or incomplete the submittal will be considered incomplete and returned to the applicant within fifteen (15) working days from the day of submittal. If the deficiencies are not corrected by the applicant within fifteen (15) working days from the time of notice of the deficiencies, the application shall be considered withdrawn.

Once a submittal has been determined to be complete, it will be reviewed for compliance with the Comprehensive Stormwater Ordinance, the City technical standards and all applicable BMP standards within sixty (60) calendar days of the completeness review. The applicant will be notified of all deficiencies and will be given an opportunity to resubmit. The applicant has sixty (60) days to resubmit or the application will be considered withdrawn. One timely resubmittal may be submitted without payment of an additional plan review fee. Once the project has been determined to meet all plan review requirements, a stormwater permit will be issued with the construction release of the project.

Drainage Plan Forms

All projects that require drainage plan approval must submit one (1) signed, original stormwater permit application and one (1) copy of the drainage plan checklist below. The project must meet the minimum drainage plan requirements listed on the checklist as well as any applicable technical standard. If the project is proposing pervious concrete or pavers for impervious area credit, then the appropriate pervious pavement BMP supplemental forms must be submitted in addition to the forms listed above. There is a $200 drainage plan review fee that must be submitted with the application packet.

Stormwater Permit Forms

All projects that require a stormwater permit must submit one (1) signed, original Stormwater Permit Application form and one (1) Stormwater Plan Review Checklist form as well as all applicable supplement forms. There is a $1000 stormwater plan review fee that must be submitted with the application packet. If the project is applying for a redevelopment exclusion, the plan review fee is $150 (all applicable forms are still required).

The Stormwater Permit Application Instructions must be read prior to completing the Stormwater Permit Application Form.

BMP Supplement Forms

All High-Density projects are required to submit one (1) supplement and one (1) checklist for each proposed BMP. One (1) operation and maintenance agreement shall be submitted for each type of BMP. If more than one BMP exists for a BMP type (i.e. three (3) wet detention basins) then each BMP number shall be referenced on the operation and maintenance agreement.

Other Supplement Forms

Each Low Density or Offsite project is required to submit the appropriate supplement form in addition to the required Stormwater Permit Forms.

Deed Restriction Forms

Any subdivision (residential or commercial) or project where a portion of the property has the potential to be sold must submit one (1) original, signed and notarized proposed property restriction document with the application packet. The proposed property restriction language is typically included in the master protective covenants for the subdivision and is required to be recorded prior to the sale of any lot. If there are no master restrictive covenants, the property restriction language must be recorded on the deed for each lot in the subdivision.
